1. Agreement and Definitions
Welcome to our Terms of Service. This document forms a legal agreement ("Agreement") between you ("User") and Jonathan Muñoz ("Provider") governing the use of our mobile applications. By utilizing any of our applications, you affirm your acceptance of these terms. Key definitions: "User Content" refers to photos, videos, or other media created or uploaded within the application by the User. "Mobile Application" refers to any software developed by the Provider designed for your mobile device. "Device" means your mobile phone, tablet, or other applicable gadgets. "Trial Period" is the duration during which free access to services is provided. "Services" refers to the various features offered by the application. "Subscription" grants full access to services with an automatic renewal option. "Free Services" are services provided at no cost.
2. Services
The Provider grants you a license to use the application for personal use. Services include content creation, in-app purchases, and more. Free Services are available during the Free Term, and the Provider may impose technical restrictions and alter functionality.
3. Authorization
The Provider authorizes your access to and use of the application. Users must register on the app store, provide necessary information, and acknowledge that the Provider processes personal data in accordance with the privacy policy. Users are responsible for account security.
4. Content
Users retain rights to User Content and grant the Provider a license to use, store, and process such content solely for the purpose of providing the services. Users are responsible for the legality of User Content, and the Provider is not liable for the loss of such content.
5. User Restrictions
Users must use the application within legal and contractual limits, refraining from copying, reverse-engineering, or creating unauthorized derivative software. The application must not be used for illegal or harmful content.
6. Provider's and User's Obligations
The Provider ensures services are performed with reasonable skill. Users pay Subscription Fees (if applicable) and ensure account security. Users must also comply with all applicable laws and regulations.
7. Term and Termination
The terms commence on the Effective Date. Termination may occur at the discretion of either User or Provider for various reasons, and upon termination, access to services ceases.
8. Fees and Payment Terms
Certain services may require payment. Subscription Fees are paid according to selected plans, and purchased content and in-app purchases are subject to the Provider's management. All payments are processed through the Apple App Store.
9. Liability
The application is provided "as is," with the Provider disclaiming warranties to the fullest extent permitted by law. The Provider is not responsible for User Content or application availability. Users indemnify the Provider for any claims and damages, and the Provider's liability is limited to the maximum extent permitted by applicable law.
10. Governing Law and Jurisdiction
These terms and conditions are governed by and construed in accordance with the laws of the Kingdom of Spain.
11. Final Provisions
The relationship between the Provider and the User is that of independent contractors. Information processing is governed by the Privacy Policy. The Provider reserves the right to interrupt services for maintenance. These terms constitute the entire agreement between the parties.
